Sheeban Ashai lambasts opposition parties for playing dubious role in passing Triple Talaq Bill
SRINAGAR, AUG 02 (PTK): Awami Itehad Party leader and State Spokesperson Sheeban Ashai today lashed out at Indian Opposition parties for playing a dubious role in passing seriously flawed legislations especially in Rajya Sabha.
Expressing his doubts over the intentions of these parties he said “How is it possible that thirty members from opposition parties were simply missing when voting took place on Triple Talaq Bill in Rajya Sabha?” These members include former cabinet ministers and party presidents, they are very well aware of Parliamentary rules.
Not dismissing speculations that many amongst the members have CBI and ED probes going on against them, he further added its crystal clear Government of the day is arm twisting the opposition parties. What is most saddening is that none of these legislations be it RTI Ammenent Bill 2019, NIA(Amendment) Bill 2019, UAPA Amendment Bill 2019 or the Triple Talaq Bill (The Muslim Women Protection of Rights on Marriage Bill)
been sent to any select or standing committee for further scrutiny. The biggest flaw in the newly passed UAPA bill is that it gives power to Government of the day to designate anyone as a terrorist without same being proven in the Courts of law. UAPA Bill has provision of police detention for a period of six months and for getting Bail onus totally lies on accused to prove his innocence to the courts of law. A clause in the NIA amendment bill says effects the interest of India which is not properly defined in the bill and has a great scope of being misused.
If someone is critical of Government of the day this law can be used against him since its not clearly defined what against interests of India means. In the triple Talaq bill Government has criminalised a civil dispute. Three years imprisonment violates the principle of proportionality, three years punishment is there for crimes like rioting and promoting enmity between two communities.
“Also when Supreme court Judgement pronounced Triple Talaq as null and void for what crime is the husband going to jail? Would a husband who is sent to jail by his wife pay for her maintenance? Moreover sending the husband to jail would close all doors of reconciliation between the couple”, Ashai said in a statement.
Lambasting the opposition for not uniting at such a crucial juncture,he said Awami Itehad Party would not be silent spectator to such injustice.
These bills have great loopholes and can prove catastrophic if adopted in the current form, the opposition parties must use all options available including approaching the Courts to ensure necessary amendments are made.
