High Court Quashes Four PSAs, Orders Detainees’ Release
The High Court of Jammu and Kashmir has invalidated four detention orders under the Public Safety Act (PSA), leading to the immediate release of the detainees. The court, in its ruling, cited a lack of thorough consideration by the detaining authority in issuing the detention orders.
As news agency Press Trust of Kashmir reports that, the individuals set to be released include Ashiq Hussain Sheikh from Bhaderwah in Doda, Yawar Ahmad Bhat from Pulwama, as well as Sageer Ahmad and Tariq Ahmad Sheikh from Srinagar.
The decision of the High Court underscores the fundamental principle that preventive detention should not be employed as a substitute for criminal proceedings. It emphasized the need for the detaining authority to provide compelling and specific reasons justifying the necessity of detention, rather than relying on vague or generalized assertions.
Of particular concern to the court was the case of Yawar Ahmad Bhat, where it criticized the detaining authority for the lack of specificity and reliance on repetitive information from police records. The court highlighted the importance of presenting individualized and substantive grounds for detention in accordance with established legal standards.
In the cases of Sageer Ahmad and Tariq Ahmad Sheikh, the court pointed out the failure of the detaining authority to consider all pertinent facts before issuing the detention orders. This omission, according to the court, rendered the detention orders legally untenable and necessitated their annulment.
The High Court’s ruling sends a clear message about the imperative of upholding due process and safeguarding individual liberties, even in matters of preventive detention. It reaffirms the principle that such measures should be employed judiciously and in strict accordance with the law, ensuring the protection of citizens’ rights and liberties.
In its concluding remarks, the court emphasized that the misuse of preventive detention undermines the principles of justice and fairness, calling for a more discerning and responsible approach from the authorities tasked with implementing such measures.
