Pulwama Court Sentences Two Accused to Life Imprisonment for 2011 Murder

Srinagar, Aug 24: The Principal Sessions Judge of Pulwama has sentenced two men, Younis Ahmad Dar and Javaid Ahmad Bhat, to life imprisonment for their involvement in a 2011 murder case. The court found them guilty under various sections of the Ranbir Penal Code (RPC), including 302 (murder), 364 (abduction), 387 (extortion), and 120-B (criminal conspiracy).
The prosecution was led by Special Public Prosecutor Mr. Gh. Mohi-ud-Din Dar, while Mr. Gazanfar Ali Advocate represented accused No. 2. M/s. Gull Mohammad Advocate and Associates defended accused Nos. 3 to 5.
In addition to life imprisonment under Section 302 RPC, the convicts were sentenced to 7 years rigorous imprisonment for abduction under Section 364 RPC and 5 years simple imprisonment for extortion under Section 387 RPC. All sentences are to run concurrently.
The court also directed the Member Secretary of the J&K Legal Services Authority to release a compensation of Rs. 3 lakhs to the parents of the deceased under the Victim Compensation Scheme, 2013.
The crime, which took place on October 28, 2011, had led to the prolonged incarceration of the convicts, who have already spent over 12 years behind bars. Due to this extended period in custody, the court ruled that they cannot be compelled to pay any additional fine or compensation to the victim’s family.
The necessary warrant of committal will be sent to the Superintendent of Central Jail Srinagar for the lodging of the convicts, pending confirmation of the sentence by the High Court. The entire case record will be submitted to the High Court for this purpose, and the convicts have been informed of their right to appeal the decision.
A copy of the sentencing order will be provided to the convicts at no cost, and another copy will be forwarded to the Member Secretary of the J&K Legal Services Authority for the disbursement of compensation. The judgement and sentencing order will also be sent to the Deputy Commissioner and the Senior Superintendent of Police for their information.
