Supreme Court Halts Implementation of FCU Notification

The Supreme Court has intervened to suspend the operation of the March 20 notification regarding the Fact Check Unit (FCU) established by the Central government under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules 2023 (IT Amendment Rules 2023).
This decision comes as the apex court stays the notification until the Bombay High Court adjudicates the challenges posed to the Information Technology Rules Amendment 2023.
The FCU, aimed at scrutinizing content pertaining to its business on social media platforms, was instituted as part of the recently amended IT Rules.
With the Supreme Court’s intervention, the fate of the FCU hangs in the balance, pending further legal deliberations. This development underscores the ongoing debate surrounding digital media regulations and their implications on freedom of expression in the country.
