J&K Cabinet Approves Proposal to Increase Retirement Age of Judicial Officers to 62 Years

Srinagar, October 3 (PTK) The Jammu and Kashmir Cabinet has reportedly cleared a proposal to increase the retirement age of judicial officers from 60 to 62 years, with retrospective effect from March 2026.
The proposed amendment is expected to benefit serving judicial officers as well as those who retired after March 2026, subject to the final government order and the conditions prescribed therein.
According to official sources, the proposal was considered and approved by the Cabinet headed by Chief Minister Omar Abdullah, who also holds the portfolio of Law, Justice and Parliamentary Affairs.
The proposal has subsequently been submitted to Lieutenant Governor Manoj Sinha for approval. A formal notification is expected to be issued by the concerned department after completion of the requisite approval process.
Retrospective Effect May Benefit Recently Retired Officers
One of the key aspects of the proposal is its proposed retrospective implementation from March 2026. If the provision is incorporated into the final notification, judicial officers who retired during the covered period may become eligible for reinstatement or restoration to service, subject to the prescribed rules and procedures.
The final government order is expected to clarify the eligibility criteria, effective date, continuity of service and other administrative and legal implications.
The proposed enhancement would also allow serving judicial officers to continue in service until attaining the revised retirement age of 62 years.
Move Follows Supreme Court Observations
The development comes amid discussions regarding the retirement age of judicial officers serving in the district judiciary. The Supreme Court of India has made observations on the issue and called upon States and Union Territories to reconsider the existing retirement age and examine the possibility of extending it to 62 years.
During the proceedings, the apex court also addressed concerns regarding the financial implications of extending the service tenure of judicial officers, observing that financial considerations should not be the sole determining factor in deciding the matter.
The issue has been discussed in the context of the experience and length of service of judicial officers, many of whom enter the judicial profession after completing legal education and meeting the prescribed eligibility requirements.
Formal Notification Awaited
The proposed change is expected to have implications for the subordinate judiciary across Jammu and Kashmir. However, the exact number of judicial officers who may benefit from the amendment, particularly those who have already retired, will become clear only after the issuance of the final government order.
Until the formal notification is issued, the implementation of the proposed revised retirement age and the restoration of recently retired officers remain subject to the approval process and the terms of the final order.(PTK)
