Reservation for pahari speaking people of JK UT
Srinagar July 16(PTK)Whereas, section 2[o) of lammu and Kashmir Reservation Act, 2004 defines the Socialy and Educationally Backward Classes as category for
providing reservation, which inckudes persons residing in the Backward Areas, Persons reskdng in the areas adjoning Actual Line of Control and Weaker and under Privileged (Social Caste) as declered under various notfications from time to tame.
Whereas, the second proviso to section 2 (o) Aurther provides for persons for persons to be echuded from the cabegory of Socialy and
Educationaly Backwerd Oasses, and one of such category is person(s)
whose annual income from al sources determined in the prescribedmanner exceeds Rs. 8.00 lacs (as per SRD-07 dated 7 anary, 2019)
Whereas,in excof powers onfered by section 23 of Jammu
and Kashmr Reservation Act, 2004, vide S.0 127 dated 20.04.2020, ne
2(xi a) was inserted to provide reservation to the ‘Pahari Speaking Aeople
which indudes persors belanging to Pahari Commurity, dan or Trbe
having distinct cutural ethnic and inguistic ikdethy to be identified in such
manner as may be prescribed;
Whereas, notfication S.0 127 dated 20.04 2020 also provides for certficate to be issued as per Form XV to the Pahari Speaking People by
the Tehsidar oncerned in terms of Rule 21 of the Jammu and Kashmir
Reservation Rules 2005;
Whereas, various representations have been received by the Social Welfare Department seeking clarification regarding isuance of certficates
to Pahari Speaking People whose income from al sources is above Rs. 8.00
lacs;
Now, keeping in view the provisions of section 2(0) of the Jammu and Kashmir Reservation Act, 2004, it is reiterated that Provison Second of
Clause (o) of section 2 of the Reservation Act, 2004 which provides for income celing up to Rs 8.00 lacs is applicable to all categories of the socially and educationaly backward classes including pahari Speaking People. As such it is clarified that the income slab of Rs &.00 lacs as provided in Proviso Seoond of clause (o) of section 2 of the Resenvation
At, 2004 is also applicable to Pahari Speaking Pecple However such
income ceiling is not applicable to persons belonging to Schedude Caste and Schedule Trbes categories.(PTK)
