Court rejects bail of Rape accused in Kulgam

Kulgam, June 12(PTK): A Local court on Friday rejected the bail application of a minor accused of raping a minor girl in South Kashmir’s Qazigund village.

Judicial Magistrate Qazigund Mudasir Farooq rejected the bail plea of accused observing that such elements needs to be dealt strictly as violence against women is on rise and minor girls are being molested and even raped in broad day light.
On May 15 a minor girl was allegedly raped by a 17-year old boy and an FIR No. 134/20 U/S 363, 506 & 109 IPC  was registered in Police Station Qazigund. The investigating agency established the offences against the accused. However the minor victim had given the statement in favor of the accused during investigation while the Bail Application of the Accused was pending for disposal.
Though the Counsels of the accused argued that the main witness had not favored the guilt of the accused in her 164 CrPC Statement however the Court was convinced by the arguments put forth by the Assistant Public Prosecutor Advocate Zahid Ahmad Mir.
Mir argued that the medical report cannot be brushed aside which was positive and the accusations against the accused were grave and heinous and that release of the accused will not only encourage him to commit such offences again without fear of law but will also encourage potential criminals of the area to indulge in such gruesome offences against women. He pleaded that Courts shall remain alive to the nature of sufferings of the victim as well as the society at large after citing various case laws on the subject.
The Court while rejecting bail Observed “Offences against the Women are on Rise and minor girls are being molested and even raped and all these offences are committed in broad day light. The parties then compromise to befool the courts and waste the precious time of the court and such practices require to be curbed to maintain the decorum within the society, and bail in such offences only give a wrong Signal to the Society”
Meanwhile the general public of Kulgam and the Police have has the order saying that the rejection of the bail will send a sense of relief and security among the young daughters and their parents and reinforce their confidence in the rule of law.
