Urges people to read carefully to expose previous J&K govt: Shaheen

SRINAGAR , Aug 13 (PTK): Taking a dig on vested interest who are trying to erode and tinkering the serious issue related to people of Jammu and Kashmir,  the leaders and members of Janta Dal United (JDU) led by its State President G M Shaheen disclosed the agreement made between Goi and Jammu and Kashmir State and is going to submit some related documents of special status given to Jammu and Kashmir Shaheen while addressing the press conference at party headquarters Rajbagh Srinagar said, “Article 35A was incorporated into the Constitution in 1954 by an order of the then President Rajendra Prasad on the advice of the Jawaharlal Nehru Cabinet. This Application to Jammu and Kashmir Order of 1954 followed the 1952 Delhi Agreement entered into between Nehru and the then Prime Minister of Jammu and Kashmir Sheikh Abdullah, which extended Indian citizenship to the ‘State subjects’ of Jammu and Kashmir.”

“Article 35-A of the Constitution of India is required to be protected so that the constitutional relationship of the State with the Union of India is maintained as is existing till date. Constitutional validity of this provision is required to be protected at all costs,” he maintained..

“Both Union of India and state government should make all possible efforts to contest the case with full zeal. State of Jammu and Kashmir enjoys unique constitutional position within the Union of India and Article 35-A is a protective umbrella for all state subject laws. Any effect on Article 35A will make such laws prone to challenge. Laws providing for privileges to State Subjects are basis of our own Constitution and any step towards weakening such laws will have disastrous effect.

He further made it clear that the issue of Article 35A case is that until an elected government is in place the state is a need of the hour. Both the Centre as well as state governments can make a request to the Supreme Court to adjourn the case because there is no democratically elected government. (PTK)
