SRINAGAR, JULY 10 (PTK): In a cheque bounce case a man was sentenced imprisonment for a term of one year and fine of Rs 15,00,000 out of the fine amount Rupees fourteen Lakh Shall be paid as companion to the complainant.
The case was filed in the court of 2nd additional muniff Judicial magistrate 1st class Srinagar, File No. 11578/2018 (116/M),Date of institution 03/10/2012, Date of decision 09/07/2018, in the case of Mohammad Yaqoob Zargar S/o Gulam Mohammad Zargar R/o khan Mohalla baghat Barzulla (Complainant) Verse Norr Ul hassan S/o Mohammad Hussian Khan R/O Ghulab bagh Srinagar regarding complaint under section 138 negotiable instruments act.
In the matter of case of cheques bearing number 889108 dated 14/8/2012 for an amount of Rs 11,03,409 drawn at JK bank Srinagar that the aforesaid cheques was presented by the complainant for encashment before his banker jk bnk Brach office Rajbagh on 27/08/2012 funds not sufficient and account is dormant that the complainant received the information about bouncing of queue from his aforesaid banker on 27/8/2012.
Then the complaint registered the case in court 0n 3/09/2012 and the tarred court 2nd additional Munsiff F.H Iqbal (judge) has announced the judgment on 9/07/2018 in whihc the judgment court has convicted Noor ul Hussian Khan Mohammad Hussian Khan R/O Ghulab bagh Srinagar.
In sentenced to undergo imprisonment for a term of one year and fine of Rs 15,00,000 out of the fine amount Rupees fourteen Lakh Shall be paid as companion to the complainant.
The remaining fine amount of Rupees one lakh shall be deposited as judicial fine under concerned head.
In default of payment of fine the accused shall undergo further simple imprisonment for further period of six months. According to court judgment.
The file is accordingly disposed of. Be consigned to record after its due completion under rules. (PTK)
